Welcome to inDrive.Courier!

 These Terms of Use (“Terms”) govern your use of the inDrive.Courier service of inDrive mobile applications, websites, products, content, facilities, and platform (collectively, the “Platform”).

These inDrive.Courier Terms of Use are an integral part of the General Terms of Use. By using the inDrive.Courier service, you express your full agreement with these Terms and the General Terms of Use. In case of any conflict or inconsistency between the provisions of these Terms and the General Terms of Use, the provisions of these Terms will apply.

You form a contract with us (“inDrive”, “we”, “us” or “our”) when you confirm that you accept these Terms or when you otherwise use the Platform.

Your use of the Platform as a Courier may be subject to designated Driver Terms of Use. Our privacy practices are described in Privacy Policy.

 

1. Business model of inDrive.Courier

1.1. Our Platform links independent third party providers of courier services (“Couriers”) and their clients (“Senders”) with each other. When Senders request a delivery of the Parcel they offer their price for the Courier’s services. The Couriers who see the request can either agree to the offered price or make a counteroffer.

1.2. The Senders are free to choose the Courier from the list of Couriers who indicated their interest in accepting the request. A separate agreement is formed between the Courier and the Sender, when the Sender confirms the transportation of the Parcel.

1.3. The Sender must pay the Courier the price that both of them agreed on via the Platform. This agreed price includes all charges associated with the transportation of the Parcel (fees, tolls, levies, taxes, etc.). inDrive does not participate and does not in any way affect the settlement between the Courier and the Sender.

 

2. Sender’s Responsibility

2.1. You as the Sender are responsible for providing accurate and complete information about the delivery, including the correct Recipient's address, contact information, and any special instructions necessary for the successful delivery of the Parcel.

2.2. You undertake to ensure unhindered passage for the Courier to the place of delivery, as well as to ensure their presence or the presence of a third party capable of accepting the Parcel at the place of the specified delivery address.

2.3. You are responsible for ensuring that the Parcel is properly packed and protected for transportation. Any damages or delays resulting from inadequate packaging or incorrect delivery information provided by you will be the sole responsibility of you.

2.4. You should not send for delivery the Parcel, which weight exceeds 20 kg for a courier by car and 10 kg for other types of couriers (walking courier, bicycle courier, motorcycle courier).

2.5. You represent and warrant that you have the legal right to possess and send the items included in the Parcel. You are responsible for ensuring that the items being sent are lawfully acquired and not in violation of any applicable laws, regulations, or restrictions.

2.6. You acknowledge that you bear full responsibility for any legal consequences or claims that may arise due to sending goods without proper ownership or authorization.

 

3. Courier’s Responsibility

3.1. You as the Courier are responsible for the safe and timely transportation of the Parcel from the point of collection to the point of delivery. You must take all necessary precautions to prevent any loss or damage to the Parcel during transportation. In the event of any loss or damage to the Parcel while in your possession, you will be held liable, subject to any limitations or exclusions of liability provided under these Terms or applicable law.

3.2. Both parties acknowledge that each party's responsibility for the delivery is limited to the respective obligations set forth above, and neither party shall be held liable for any failure or delay in the delivery caused by circumstances beyond their reasonable control, including, but not limited to, natural disasters, governmental actions, or any other force majeure events.

3.3. In the event of an unsuccessful delivery due to the Recipient's unavailability, incorrect delivery information provided by the Sender, or any other reason beyond the Courier's reasonable control, inDrive does not take responsibility for storing the Parcel. The Sender and the Recipient should be aware that in such cases, they must make alternative arrangements for the Parcel's storage or handling.

3.4. When accepting the Parcel from the Sender, you have the right, but not the obligation, to:

3.4.1. carefully read its contents;

3.4.2. ask the Sender to show the contents and seal the package with you.

3.4.3. do not accept the Parcel if the Sender refuses to show the contents, or if the contents seem suspicious or illegal

 

4. Restricted Goods

4.1. When you use the Platform, you are responsible for ensuring that the Parcel being delivered is not a restricted good.

4.2. Restricted Goods, including but not limited to:

4.2.1. We recommend that the value of any parcel sent via the Platform does not exceed 700 BWP. By using the Platform, you acknowledge that inDrive is not liable for any loss, damage, or issues related to the delivery of your parcel, regardless of its value,

4.2.2. narcotic drugs, prescription drugs, psychotropic, potent, toxic, radioactive, explosive,

4.2.3. poisonous, caustic, flammable and other hazardous substances, including those under pressure;

4.2.4. firearms, pneumatic, gas or cold weapons and their parts, ammunition, fireworks, signal flares and cartridges;

4.2.5. foreign currency and banknotes;

4.2.6. high value items e.g. jewellery, precious metals, precious stones and products containing them;

4.2.7. items and substances that, by their nature or because of their packaging, may pose a danger to people, contaminate or spoil (damage) other goods, people or objects around them;

4.2.8. people, regulated species, animals and plants, biological materials;

4.2.9. items requiring specially equipped vehicles for transportation, including foodstuffs;

4.2.10. liquids in non-specified containers;

4.2.11. fragile items without special packaging;

4.2.12. all shipments prohibited by law;

4.2.13. illegal or stolen goods, pirated products or counterfeit goods;

4.2.14. hazardous waste, such as batteries;

4.2.15. explosive materials and components;

4.2.16. alcoholic beverages;

4.2.17. tobacco products and electronic cigarettes.
